1. Introduction

Welcome to Momentum.

Momentum is a productivity and focus application operated by ENGLISH MONSTR, TOO, a company registered in the Republic of Kazakhstan.

Throughout these Terms, “Momentum”, “we”, “our”, and “us” refer to ENGLISH MONSTR, TOO.

By downloading, accessing, or using Momentum, you acknowledge that you have read, understood, and agreed to these Terms of Service.

If you do not agree with these Terms, you must discontinue use of Momentum.

2. Eligibility

You must be legally capable of entering into a binding agreement under the laws applicable to you in order to use Momentum.

If you are a minor, you may use Momentum only where permitted by applicable law and with the involvement or authorization of a parent or legal guardian where required.

3. The Momentum Service

Momentum provides productivity and focus tools that may include:

• Focus timers
• Focus profiles
• Break timers
• Routines
• Focus statistics
• Productivity history
• Audio and soundscapes
• Apple Music integration
• Data export
• Subscription features

Features may change, be added, or be removed over time.

4. Use of the Application

You agree to use Momentum only for lawful purposes.

You may not:

• Attempt unauthorized access to Momentum or its systems.
• Reverse engineer or decompile the application except where permitted by applicable law.
• Circumvent security mechanisms.
• Interfere with the operation of Momentum.
• Use automated systems to abuse or overload the service.
• Attempt to obtain paid features without authorization.
• Use Momentum for unlawful purposes.
• Upload or transmit malicious software through any supported functionality.

5. Focus and Productivity Features

Momentum is a productivity tool.

Focus timers, statistics, recommendations, routines, and other productivity information are provided for informational and organizational purposes only.

Momentum does not guarantee any particular level of productivity, concentration, performance, academic achievement, professional performance, or other result.

6. Apple Music

Momentum may allow you to use Apple Music during focus sessions.

Apple Music functionality is provided through Apple’s services and is subject to Apple’s applicable terms, policies, availability, and subscription requirements.

Momentum does not guarantee continuous availability of Apple Music content or services.

You are responsible for maintaining any Apple Music subscription required to access catalog content.

7. Subscriptions and Momentum Pro

Momentum may offer paid subscription features under the name Momentum Pro.

Subscription pricing, billing period, introductory offers, renewal terms, and included features will be presented through the applicable purchase interface.

Subscriptions purchased through the Apple App Store are billed by Apple and are subject to Apple’s applicable terms.

Unless otherwise stated, subscriptions automatically renew unless cancelled through the applicable Apple account settings before the renewal date.

Momentum does not control Apple’s refund policies or payment-processing systems.

Momentum may use RevenueCat or another subscription-management service to manage subscription status and related functionality.

8. Changes to Subscription Features

Momentum may modify the features included in Momentum Pro or other paid offerings.

Where required by applicable law, users will receive appropriate notice of material changes.

Changes to pricing or subscription terms will be presented in accordance with applicable App Store and legal requirements.

9. Data Export

Momentum may allow you to export certain information in CSV format.

Exported files are provided for your convenience.

You are responsible for the security, storage, backup, and subsequent use of exported information.

10. Intellectual Property

Momentum and its associated materials, including but not limited to:

• Software
• Source code
• Designs
• User interfaces
• Logos
• Branding
• Graphics
• Audio assets
• Text
• Features
• Product architecture

are owned by ENGLISH MONSTR, TOO or its licensors and are protected by applicable intellectual property laws.

Except where expressly permitted, no ownership rights are transferred to you.

11. Third-Party Services

Momentum may rely on third-party services to provide certain functionality.

These services may include Apple services, payment infrastructure, subscription-management services, hosting providers, analytics services, or other technical providers.

Third-party services may be governed by their own terms and policies.

Momentum is not responsible for independent failures or changes to third-party services beyond its reasonable control.

12. Availability

Momentum is provided on an “as available” basis.

We may temporarily suspend or limit access to Momentum for maintenance, security updates, technical problems, infrastructure changes, or circumstances beyond our reasonable control.

We do not guarantee that Momentum will always be available, uninterrupted, or error-free.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Momentum is provided on an “as is” and “as available” basis.

We disclaim warranties that cannot lawfully be excluded, including implied warranties of merchantability, fitness for a particular purpose, availability, and non-infringement to the extent permitted by law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, ENGLISH MONSTR, TOO shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Momentum.

This includes, where legally permitted, loss of data, loss of profits, business interruption, or loss of goodwill.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. Account and Access Termination

We may suspend or terminate access to Momentum where reasonably necessary to:

• Prevent fraud or abuse
• Protect the service
• Protect users
• Address security issues
• Enforce these Terms
• Comply with applicable law

You may stop using Momentum at any time.

16. Changes to These Terms

We may update these Terms from time to time.

Updated versions may be published within Momentum or through associated websites or support channels.

The updated Terms become effective when published unless otherwise stated.

17. Governing Law

These Terms shall be governed by the laws of the Republic of Kazakhstan, except to the extent that applicable consumer-protection or other mandatory laws provide otherwise.

Disputes shall be subject to the jurisdiction of the competent courts of the Republic of Kazakhstan, subject to any mandatory rights you may have under applicable law.
